Products Liability Law
What is products liability?
Products liability is a legal term that refers to the responsibility of manufacturers, distributors, and sellers for the harm caused by their products to consumers or bystanders. Products liability law covers a wide range of products, such as vehicles, toys, appliances, and machinery.
Products liability law is based on the principle that the people who make and sell products have a duty to ensure that their products are safe and fit for their intended use. If they fail to meet this duty, and their products cause injury or damage, they can be held liable for the resulting losses.
How does products liability work?
- Negligence: This theory applies when the product maker or seller fails to exercise reasonable care in the design, manufacture, testing, inspection, or marketing of the product, and this failure causes harm to the user or a third party.
- Strict liability: This theory applies when the product is defective in itself, regardless of the fault or care of the product maker or seller. A product can be defective in three ways: design defect, manufacturing defect, or failure to warn. Under strict liability, the product maker or seller is liable for any harm caused by the product, even if they did not know or could not have known about the defect.
- Breach of warranty: This theory applies when the product maker or seller makes a promise or representation about the product, either express or implied, and the product does not conform to that promise or representation. For example, a product may have a warranty of merchantability, which means that it is fit for the ordinary purposes for which it is used, or a warranty of fitness for a particular purpose, which means that it is suitable for a specific use that the buyer relies on.
